Rental Terms & Conditions

These general terms and conditions apply to any rental entered into with SiramodDrive (the "lessor") and the customer (the "renter"). They are identical to the terms of the rental contract signed when the vehicle is collected. By making a booking, the renter declares that they have read and accept them.
Article 1 — Use of the vehicle
The renter undertakes not to allow the vehicle to be driven by a third party not named in the contract without the lessor's written authorisation. The vehicle must not be used for the carriage of goods or persons for payment, for subletting, for competitions or trials, nor be driven outside the authorised road network. Driving under the influence of alcohol or narcotics is strictly prohibited.
Article 2 — Condition of the vehicle
The vehicle is delivered in perfect working order and clean condition, with its accessories and on-board documents. The renter undertakes to return it in the same condition. Any exceptional cleaning or any missing item will be charged to the renter.
Article 3 — Fuel and oil
Fuel is at the renter's expense. The renter must regularly check the oil and water levels and report any anomaly to the lessor without delay.
Article 4 — Maintenance and repairs
Normal mechanical wear is borne by the lessor. Any repair resulting from abnormal use, from the renter's negligence or from an accident (including punctured or damaged tyres) is borne by the renter. No repair may be undertaken without the lessor's prior agreement.
Article 5 — Insurance
The vehicle is covered by third-party insurance. In the event of an accident, the renter must report it to the lessor and to the authorities within the legal time limits and draw up an accident report. The cover does not apply in the event of driving without a valid licence, under the influence of alcohol or narcotics, or in the event of failure to comply with these terms.
Article 6 — Rental, deposit and extension
A deposit (security deposit) is required when the vehicle is collected; it is refunded on return after inspection of the vehicle's condition. Any extension of the rental must be requested and accepted by the lessor before the due date; failing this, the renter is liable to prosecution for misappropriation of the vehicle.
Article 7 — Price and payment of the rental
The rental price is the one indicated on the front of the contract. Payment of the rental is made in advance, for the entire agreed period.
Article 8 — Return of the vehicle
The vehicle is returned at the place, on the date and at the time agreed in the contract. Any unauthorised delay may be invoiced and, where applicable, give rise to prosecution.
Article 9 — Liability
The renter remains liable for the fines, penalties and official reports drawn up against them throughout the entire rental period.
Article 10 — Jurisdiction
In the event of a dispute, the Regional Court of Agadir shall have sole jurisdiction.
